Can the owner charge me for damage that was already there?

If you feel you are being unfairly charged for damage you didn't do, you will need to prove that you did not cause the damage. If you have dated photographic evidence of the damage from when you moved in, this will be helpful.

By law, the owner or agent must give you two Property Condition Reports as soon as you move in. The owner or agent may complete this with you, but if not you can do it and give them a copy. On this form, detail any damage in the property, and if possible take photos to keep, this will help ensure that you are not charged for the damage when you leave.
